Following the politicized uproar over the so-called lenient sentence that Brock Turner received for his sexual encounter with a drunk woman at a Stanford party, the California legislature has passed yet another “rape” law by 66-0 which is awaiting Governor Jerry Brown’s signature.
Under the new law, a defendant would face a minimum of 3-years in prison if he has sex, oral, digital, or otherwise with a woman who is “incapable of giving consent due to intoxication”.
This new law is a nightmare.
It places the burden on the Man to determine whether an intoxicated woman is capable of giving consent. In reality, there very few scenarios between two individuals who are drinking alcohol (or consuming other substances) where this conversation or thought process actually occurs.
The effect of the law is to allow a woman to get voluntarily drunk, have sex (or engage in other sexual acts) and then later claim that her state of intoxication prevented her from giving consent.
Under the language of the law, it covers “penetration with a foreign object” which can include fingers. Given the obvious physical differences between a man and woman, this law is biased against Men who are the natural “penetrators” during a sexual act.
If convicted under the new law, you will face a minimum prison term of 3 years if it is determined that the intoxicated woman was not capable of providing consent.

Drunk or stoned? Scientists have figured out which type of sex is better
While many may not have been aware that a debate was raging among the scientific community as to whether sex was better when drunk or high, researchers at New York University have finally figured it out.
Through a series of in-depth interviews with 24 heterosexual adults, Joseph Palamar and his team found that having sex while high was better on a number of fronts.
Firstly, “beer goggles” do in fact impact your choice of sexual partner. Not only that, respondents "overwhelmingly” reported their standards were lowered when drinking alcohol, whereas when smoking marijuana, this wasn’t an issue.
"With weed I know who I’m waking up with. With drinking, you don’t know. Once you start drinking, everybody looks good," one female respondent told researchers.
Drunken sex also generated negative feelings for many respondents, who were left feeling ashamed, embarrassed or just a general sense of regret, something which was “rarely reported” with marijuana users, the study in the July issue of the journal Archives of Sexual Behaviour says.
"I want to cook the person something to eat [after sex] when I’m high," one male respondent said.
"When I’m drunk, it’s like, 'I'm out of here.' Or get away from me."
Those under the influence of alcohol during sex also reported that they would often feel sick or dizzy, as well as being more likely to blackout and forget who they were with.
Similarly, participants said they would often find themselves distracted having sex while high, with one female even telling researchers that "you start thinking sex is weird."
Palmer also found that being high or drunk during sex can impact how much pleasure you feel. "Alcohol tended to numb sensations and marijuana tended to enhance sensations," the study says, based on feedback received from respondents.
Sex while high was found to be “involve more sensuality than alcohol," and both men and women reported "intensified" orgasms during sex with one female respondent claiming hers were "magnified at least by five times."

Overall, respondents admitted that alcohol led them to be engage in riskier behavior when it comes to sex resulting in poorer judgments being made and whether they used protection.
On the other end of the scale, one participant admitted that "marijuana use decreased his likelihood of engaging in risk behavior because while high he was too paranoid to give in.”
this law needs ruled unconstitutional.
the reason is: a major study was conducted proving that alcohol makes both men and women forget everything they did while intoxicated. this would mean, a women or man consenting would have no idea why they consented. but also, the study proved alcohol makes women and man prone to copulate, so this would mean a drunk women even though she claimed rape, would in fact likely seek out a dick to fuck, then later deny she did seek it out, or forget she did. she would be more likely to have feelings of regret, or think she was raped when she wasn't.
unfortunately this is a product liability issue with alcohol. people demand alcohol be made available for consumption. people then buy or seek it out, and consume it. they in fact give informed consent to have the "alcohol experience," including seeking sex out, forgetting what one was doing, and then claiming rape afterwards.
therefore this law is crooked. there is scientific basis to believe many convictions or rape cases were in fact consensual, and not rape, even though the cases are being prosecuted as rape.
